Terms and Conditions of Sale (CGV)

1. Scope

These Terms and Conditions of Sale ("T&C") govern the sale of products by tinch ("the Seller") through its ecommerce website. By placing an order, the customer ("the Customer") agrees to be bound by these T&C without reservation.

2. Products

The products offered for sale are those described on the website at the time of consultation. tinch makes every effort to ensure that product descriptions, images, and specifications are accurate. However, minor variations may occur.

3. Prices

All prices are indicated in the currency displayed on the website and include applicable taxes unless otherwise stated. Shipping costs are specified before order confirmation. tinch reserves the right to modify prices at any time, but products will be invoiced based on the rates in effect at the time of order confirmation.

4. Orders

Orders are placed through the website. An order is considered final once payment has been successfully completed and the Customer has received an order confirmation email. tinch reserves the right to refuse or cancel any order in case of dispute, suspected fraud, or non-payment.

5. Payment

Payment is due in full at the time of order. Payments are processed securely through Stripe. tinch does not store or have access to the Customer’s full payment card details. Stripe processes payments in compliance with applicable security standards, including PCI-DSS requirements. Accepted payment methods are displayed at checkout.

6. Delivery

Products are delivered to the address provided by the Customer during checkout. Delivery times are indicated for informational purposes and may vary depending on the destination. tinch is not responsible for delays caused by carriers or events beyond its reasonable control.

The risk of loss or damage passes to the Customer upon delivery.

7. Right of Withdrawal

In accordance with applicable consumer protection laws, Customers have the right to withdraw from their purchase within fourteen (14) days from the date of receipt of the products, without providing any reason.

To exercise the right of withdrawal, the Customer must notify tinch in writing at [email protected] before the expiration of the withdrawal period. Products must be returned unused, in their original condition and packaging.

Refunds will be issued within fourteen (14) days of receipt of the returned products, using the same payment method as the original transaction. Return shipping costs are borne by the Customer unless otherwise required by law.

8. Legal Guarantees

Products sold by tinch benefit from the legal guarantees provided by applicable law, including the guarantee of conformity and the guarantee against hidden defects.

If a product is defective or non-conforming, the Customer must contact tinch at [email protected] with proof of purchase and a description of the issue. tinch will provide instructions for return, repair, replacement, or refund as required by law.

9. Complaints

For any complaints or inquiries, Customers may contact tinch at [email protected]. tinch will make reasonable efforts to respond promptly and resolve any dispute amicably.

10. Applicable Law and Jurisdiction

These T&C are governed by the laws applicable in the Seller’s country of establishment, without prejudice to mandatory consumer protection provisions applicable in the Customer’s country of residence.

In the event of a dispute, and failing an amicable resolution, the competent courts of the Seller’s place of establishment shall have jurisdiction, subject to mandatory legal provisions.
